Yandri Hernandez, arrested for an assault on a 15 year old girl inside the ladies room of the Museum of Science, was “warned pursuant to alien status” that his conviction may result in “deportation, exclusion from admission to the United States, or denial of naturalization” according to public court records. The official court warning came in early June as Hernandez was facing felony charges for the nighttime B&E of a vehicle/boat, he was released on personal recognizance and due back in court on August 5th.
However, an arrest warrant was issued for Hernandez as “defendant defaulted” by failing to appear for his August court date. Hernandez’s address was listed as “Homeless, MA” on his June arrest record with the Somerville Police Department.
Attorney Lorraine Belostrock told the court today that the 24-year-old is homeless and suffers from substance abuse issues and that he needs help, not jail, according to Fox25.
Fox25 quoted Belostrock as telling the court: “This seems to be just an isolated incident due to the substance abuse issue and the homelessness.”
Hernandez was arrested on September 23 (charges included possession of a class B substance) and the warrant was vacated, however before he was released on bail the court removed random drug testing as a condition of his release.
